Cyberhorse Racing Club
operates under the following terms and conditions effective from 01/10/04:-
- The Cyberhorse Racing Club will race a number of horses
owned or leased in whole or part by Cyberhorse.
- Each horse raced by the Cyberhorse Racing Club will be
selected and managed by Cyberhorse.
- The Cyberhorse Racing Club is a permanent facility provided
by Cyberhorse.
- As an incentive for clients to subscribe to its Virtual
FormGuide form and ratings services Cyberhorse offers Membership of the Cyberhorse Racing
Club to such subscribers.
- Cyberhorse Racing Club Memberships are only available to
subscribers to qualifying Virtual FormGuide services. These Qualifying Subscriptions are
the Cyberhorse Racing Club, Pro Punter, Punter, By-A-Nose or Ratings services.
- Cyberhorse Racing Club Members enjoy the interest of
following the racing career of the Club's horses, but do not own an interest in the horses
themselves. Each Club Member's interest in the horse is thus limited to his/her enjoyment
of following the horses' racing career, plus social activities arranged for Club Members
by Cyberhorse.
- Cyberhorse pays all purchase costs for the horses plus all
training and administrative expenses. As Members are not expected to pay for the cost of
the horse itself, the subscription to the Virtual FormGuide service is the only cost.
- Cyberhorse Racing Club horses will be trained by a reputable
trainer selected by Cyberhorse.
- Club Members will be provided via a secure web page and/or
email with regular reports relating to the horses while they are in work.
- Net prizemoney (ie after trainers and jockeys percentages
and any lease fees payable) will be paid to Cyberhorse in order to recover its costs for
purchase, training and administration. Any surplus of prizemoney earned in excess of the
costs of running the Club will be applied by Cyberhorse to the acquisition of new horses
for the Club.
- Periodically, Cyberhorse will review each horse in the
Cyberhorse Racing Club stable and decide if the horse is to continue racing. Such
decisions will be absolutely at the discretion of Cyberhorse and other part owners (if
any) of the horse concerned.
- Cyberhorse offers no guarantee that a Club horse will ever
race. Injury, immaturity or lack of ability may prevent a Club horse from racing. In this
event, Cyberhorse may, at its absolute discretion, substitute another horse for the
original.
- Note that Club Membership is only available to subscribers
to Virtual FormGuide services. In offering the Club Membership component in certain of its
Virtual FormGuide services, Cyberhorse specifically states that it is providing its
subscribers with an economical way of participating in the enjoyment of racing a horse,
without the risks and costs associated with ownership.
- If at any time, a Club Member's Qualifying Subscription
lapses, his Cyberhorse Racing Club Membership automatically lapses also. He will then not
have access to horse reports or be able to participate in Cyberhorse Racing Club
activities.
